Townline Developments Inc. on behalf of the Musqueam Block F Land Ltd. has applied for a CHANGE OF LAND USE DISTRICT APPLICATION to amend the existing CD-2 zoning for leləṁ Lots E, F, G, H and I, District Lot 140 Group 1.

The proposed amendments would permit additional density allotment to the parcels of 31,149.18 square metres (335,287 square feet) in the form of market rental housing. The form of development would include five residential towers ranging from 22 to 34 storeys to a maximum height of 107 metres as well as townhomes at grade and a maximum combined Floor Space Ratio (FSR) of 4.0.

UEL Land Use, Building and Community Administration Bylaw Amendment

On October 18, 2023, pursuant to Section 12 of the University Endowment Land Act, the Minister of Municipal Affairs amended the UEL Land Use, Building and Community Administration Bylaw to implement the Change of Land Use District (rezoning) application #3/21 at 2026 and 2076 Wesbrook Mall. The Bylaw is amended to add a new site specific comprehensive Land Use District, CD-3, to:

  • Permit 4-6 storey mixed use institutional, student dorm and residential building with two levels of underground parking to a maximum FSR of 3.0

BACKGROUND

Shape Architecture Inc. on behalf of the Pacific Centre for Discipleship Association applied for a Change of Land Use District (rezoning) on May 21, 2021 to create a new site-specific comprehensive Land Use District to permit a 4 to 6 storey mixed-use Institutional, Student Dorm and Residential at 2026 and 2076 Wesbrook Mall.

These amendments will implement the Change of Land Use District (rezoning) application #3/21.

On June 28, 2023, pursuant to Section 12 of the University Endowment Land Act, the Minister of Municipal Affairs amended the UEL Land Use, Building and Community Administration Bylaw to implement the Change of Land Use District (rezoning) application #1/21 at 2620 Acadia Road. The CD-2 Land Use District for Lot 5 Community Facilities Child Day Care Centre is amended to:

  • Increase the maximum allowable floor area from 465 m2 to 1,105 m2 over two storeys
  • Increase the maximum allowable height from 8 metres to 8.5 metres
  • Allow for projection of an architectural feature canopy into the required 4.6 metre setback
  • Reduce the number of required off-street staff parking spaces to a total of three

    Polygon Development 339 Ltd. applied to the UEL on behalf of the Musqueam Block F Limited Partnership for a Change of Land Use District (rezoning) on December 22, 2020 to allow for a larger Child Day Care Facility at 2620 Acadia Road.

    Official Community Plan Amendments

    Pursuant to Section 12 of the University Endowment Land Act, the Minister of Municipal Affairs has amended the UEL Official Community Plan (OCP) to:

    • Establish a framework for the election of community representatives to the Advisory Design Panel (ADP) and Community Advisory Council (CAC);
    • Confirm volunteer status for community representatives;
    • Require an opportunity for all property owners to participate in meetings of the CAC;
    • Enable the UEL administration to call elections of community representatives on the CAC or ADP in extenuating circumstances;
    • Transfer responsibility for appointment of professional members to the ADP to the UEL Manager; and,
    • Limit the role of professional members on the ADP to their field of practice.

    BACKGROUND

    The University Endowment Lands Official Community Plan (OCP), Section 4.1 a) and b) provides the authority for the creation of the Community Advisory Council (CAC) and the Advisory Design Panel (ADP), respectively. Authority to create a third advisory group, the Community Centre Advisory Board, was approved by the Minister of Municipal Affairs through an amendment of the OCP, Section 4.1 c) in December 2021.

    As the CAC and ADP provide advice to the Manager, as the Minister’s delegated authority for the UEL, the Manager requested the changes to improve the function and structure of the CAC and ADP.

    • To add associated regulations related to cannabis retail
    • To repeal Schedule 13 - Schedule to Restrict Smoking

    UEL Fees Bylaw

    • To add a fee of $400.00 for a cannabis retail store business licence

    BACKGROUND

    Burb Cannabis Corporation applied to the UEL on behalf of Mandial Holdings Ltd. for a Change of Land Use District (rezoning) to allow for the conditional use of a non-medical cannabis retail store at 5784 University Boulevard. These amendments will implement the Change of Land Use District (rezoning) application #1/20 at 5784 University Boulevard applied for by Burb Cannabis Corporation of June 5, 2020.

    On March 30th, 2022, pursuant to Section 12 of the University Endowment Land Act, the Minister of Municipal Affairs amended and enacted the following bylaws:

    UEL Fees Bylaw

    • Updated fee structure to replace fees previously found in the Land Use, Building and Community Administration Bylaw and the Works & Services Bylaw

    Land Use, Building and Community Administration Bylaw

    • Amended the Bylaw to reference the UEL Fees Bylaw
    • Repealed subsections (1) through (11); (12)(a) through (12)(c), and (14) of Schedule 2

    Works & Services Bylaw

    • Amended Schedule A to reference the UEL Fees Bylaw
    • Repealed Sections 1 through 4 of Schedule A

    BACKGROUND

    The UEL fees were set out in Schedule 2 of the UEL Land Use, Building and Community Administration Bylaw (LUB) and Schedule A of the Works and Services Bylaw, as authorized under s. 12(1)(f) of the UEL Act. The UEL’s existing fee structure has not been substantially updated since 1989. The new UEL Fees Bylaw includes an updated fee structure that consolidates fees into a single bylaw for improved clarity and function.

    The bylaw amendments amend the UEL Land Use, Building and Community Administration Bylaw and the UEL Works and Services Bylaw, and enact the UEL Fees Bylaw

    Official Community Plan Amendments

    Pursuant to Section 12 of the University Endowment Land Act, the Minister of Municipal Affairs amended the UEL Official Community Plan to:

    • Implement the Area D Neighbourhood Plan (Ministerial Order M164 signed April 6, 2021); and
    • Create a Community Centre Advisory Board that will have input into operations of the future UEL community centre. (Ministerial Order M523 signed December 10, 2021)

    BACKGROUND

    In 2016, bylaws were created for the leləm development (Block F) that require the Musqueam Capital Corporation (MCC) to build a community centre and turn it over to the Province to operate for the benefit of UEL residents. In 2018, MCC proposed an additional funding source for the community centre in the form of guaranteed community centre memberships from leləm strata residents in exchange for them having input into the operations of the community centre through seats on an advisory board. The bylaw amendment amends the UEL Official Community Plan to establish this advisory board.

    Official Community Plan Amendment - Draft Bylaw for Referral

    The University Endowment Lands Official Community Plan (OCP), Section 4.1 a) and b) provides the authority for the creation of the Community Advisory Council (CAC) and the Advisory Design Panel (ADP), respectively. Authority to create a third advisory group, the Community Centre Advisory Board, was approved by the Minister of Municipal Affairs through the amendment of the OCP Section 4.1 c) in 2021.

    As the CAC and ADP provide advice to the Manager, as the Minister’s delegated authority for the UEL, the Manager has requested changes to improve the function and structure of the CAC and ADP.

    Accordingly, pursuant to Section 8 of the University Endowment Lands Land Use, Building and Community Administration Bylaw, on behalf of the Minister, the Manager is referring the Official Community Plan bylaw amendment to the Community Advisory Council and Advisory Design Panel.     AREA D NEIGHBOURHOOD PLAN

    On April 6, 2021, pursuant to Section 12(5) of the University Endowment Land Act, the Minister of Municipal Affairs amended the following bylaws to incorporate the Area D Neighbourhood Plan:
    Official Community Plan

    • to update land use designations and maps for Area D;
    • ancillary and other amendments related to the inclusion of the Area D Neighbourhood Plan; and
    • to include the Area D Neighbourhood Plan as Appendix 1.

    Land Use, Building and Community Administration Bylaw

    • to update the bylaw related to the Area D Neighbourhood Plan;
    • to amend the bylaw related to bicycle parking provisions, EV parking and charging, BC Energy Step Code, home occupation, adaptable dwelling units, noise guidelines;
    • to include a new Schedule on Rental Protection; and
    • to update and consolidate design guidelines.

    • to ensure consistent numbering of an Appendix
